1. Purpose of Website
This website is maintained by Jefferson Club Condominium Association, Inc. ("Association") in compliance with Florida Statute 718.111(12)(g) to provide unit owners with electronic access to official association records and to facilitate communication within our community. Effective January 1, 2026, Florida law requires condominium associations with 25 or more units to maintain such a website.
2. User Eligibility and Access
Public Areas: General information about the Association is available to all visitors.
Owner Portal: The password-protected owner portal is restricted to:
- Current unit owners of Jefferson Club Condominium
- Authorized representatives of unit owners (with proper written documentation)
- Association employees and board members acting in their official capacity
This restriction complies with Florida Statute 718.111(12)(g), which requires that official records posted to the website be maintained in a password-protected electronic location inaccessible to the general public.
3. Account Responsibilities
If you are granted access to the owner portal, you agree to:
- Provide accurate and current information during registration
- Maintain the confidentiality of your unique username and password
- Notify the Association immediately of any unauthorized use of your account
- Not share your login credentials with non-owners or unauthorized persons
- Accept responsibility for all activities that occur under your account
4. Permitted Use of Official Records
In accordance with Florida Statute 718.111(12)(c), official records accessed through this website:
- May be used for purposes reasonably related to your ownership interest in the condominium
- May not be used for commercial purposes unrelated to the Association
- May not be sold, distributed, or used for commercial solicitation without express written Association approval
- Shall not be used to harass, threaten, or intimidate other unit owners, board members, or association personnel
The Association may charge reasonable fees for copies of records in accordance with §718.111(12)(c).
5. Prohibited Conduct
Users of this website agree not to:
- Attempt to gain unauthorized access to any portion of the website, owner portal, or association records
- Use any automated system, software, or process to access the website in a manner that exceeds reasonable use
- Upload viruses, malware, or other harmful code
- Interfere with the proper functioning of the website
- Impersonate another person or misrepresent your affiliation with the Association
- Violate any applicable local, state, or federal law, including the Florida Condominium Act
- Use information obtained from the website to facilitate identity theft or fraud

7. Document Accuracy and Official Records
While we strive to ensure all documents posted on this website are accurate and current per Florida Statute 718.111(12)(g), the official versions of all governing documents are those recorded with the appropriate Florida county recording office. In case of any discrepancy between documents on this website and recorded documents, the recorded documents shall control. The Association posts documents within 30 days of receipt or creation as required by law.

This website is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The Association does not warrant that the website will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
9. Limitation of Liability
To the fullest extent permitted by Florida law, including but not limited to §617.0831 (relating to director and officer liability for not-for-profit corporations), the Association, its board members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or any information obtained through it.
10. Indemnification
You agree to indemnify, defend, and hold harmless the Association, its board members, officers, employees, agents, and property management company from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms of Use, your use of this website, or your violation of any rights of another party.
11. Governing Law and Venue
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Florida, including the Florida Condominium Act (Chapter 718, Florida Statutes) and the Florida Not For Profit Corporation Act (Chapter 617, Florida Statutes). Any legal action or proceeding shall be brought exclusively in the state or federal courts located in the county where the condominium is situated.
12. Dispute Resolution
Before initiating any legal action, disputes related to this website, official records access, or association matters shall be subject to the mandatory non-binding arbitration and pre-suit mediation requirements of Florida Statute 718.1255, where applicable. The Division of Florida Condominiums, Timeshares, and Mobile Homes provides arbitration and mediation services for qualifying disputes.
13. Modifications to Terms
The Association reserves the right to modify these Terms of Use at any time. Changes will be effective upon posting to this website. Your continued use of the website after changes are posted constitutes your acceptance of the modified terms. We encourage you to review these terms periodically.
14. Termination of Access
The Association may terminate or suspend your access to the owner portal at any time for:
- Violation of these Terms of Use
- Sale, transfer, or other disposition of your unit
- Foreclosure or other legal proceeding affecting your ownership
- Any other reason permitted by Florida law or the Association's governing documents
Access rights terminate automatically when you are no longer a unit owner of record.
15. Severability
If any provision of these Terms of Use is found to be invalid or unenforceable under Florida law, the remaining provisions shall continue in full force and effect.
